Terms and Conditions for Use of the Alpha Omega Preparatory Academy Website
Effective Date: August 7, 2026
These Terms and Conditions ("Terms") govern your access to and use of the website and related online platforms operated by Alpha Omega Preparatory Academy ("School," "we," "us," or "our"), a private educational institution located in Georgia, including the enrollment portal, the applicant portal, tuition and fee payment features, and donation features.
By accessing this website, submitting an application or enrollment form, making a tuition or fee payment, making a donation, or otherwise interacting with our online services, you ("you" or "your"), whether as a parent, guardian, adult student, donor, or visitor, agree to be bound by these Terms. These Terms form a legally binding agreement between you and the School. If you do not agree to these Terms, you must discontinue use of the website.
1. Use of the Website
This website is provided for informational and educational purposes and for the administration of admissions, enrollment, tuition and fee payments, and charitable giving. You agree to use the website only for lawful purposes and in a manner that does not infringe the rights of, or restrict the use of, this website by any other party. The School reserves the right to refuse, suspend, or terminate access at its sole discretion, including for suspected fraud, unauthorized access, or violation of these Terms.
2. Accuracy of Information
Content on this website, including program descriptions, tuition figures, calendars, and fee schedules, is provided for informational purposes and is subject to change without notice. While we strive for accuracy, the School makes no warranties regarding website content, and typographical or clerical errors do not bind the School. Tuition, fees, and enrollment obligations are governed by the applicable Enrollment Contract, which controls in the event of any conflict with this website.
3. Tuition, Fees, and Payments
Application fees, registration fees, tuition, and other school fees are established by the School and are payable in accordance with the Enrollment Contract and any payment plan you select. All amounts are stated in U.S. dollars.
• Payment Authorization: You authorize the School to charge the payment method you provide for the amounts you agree to pay. Payments are processed through a third-party payment processor; the School does not control and is not responsible for the operations of that processor. Declined or returned payments may result in late fees and, where permitted, suspension of services in accordance with the Enrollment Contract.
• Refunds of Tuition and Fees: Refund eligibility for tuition and school fees is governed exclusively by the Enrollment Contract. Application and registration fees are non-refundable except where required by applicable law.
• Taxes: Where applicable under Georgia law (O.C.G.A. § 48-8-3), taxes may be assessed on any taxable item or service. Exemption documentation must be provided prior to payment.
4. Donations
Donations made through this website are voluntary charitable contributions and are, except where the School expressly states otherwise in writing, non-refundable and non-transferable. Recurring donations continue until cancelled by the donor or the School. You may cancel a recurring donation at any time using the method provided to you or by contacting the School. The School applies donated funds to the designated fund where one is selected, and otherwise to the area of greatest need. Donors are responsible for determining the tax treatment of any contribution and should consult their own tax advisor.
5. Applications, Enrollment, and Submitted Information
Submission of an application or enrollment form does not constitute acceptance. Admission decisions are made solely by the School. You are responsible for the accuracy and completeness of all information and documents you submit, including student records, medical information, and guardian contact information. The School may verify, retain, or decline to act upon any submitted information at its discretion.
6. Account and Portal Security
If you create an account or portal login, you are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You agree to notify the School promptly of any unauthorized use. The School is not liable for losses arising from your failure to safeguard your credentials.
7. Privacy
Your use of this website is also governed by our Privacy Policy, which describes how the School collects, uses, and discloses information, including student and parent information protected under the Family Educational Rights and Privacy Act (FERPA). The Privacy Policy is incorporated into these Terms by reference.
8. Intellectual Property
All content on this website, including text, graphics, logos, photographs, videos, and the School name and marks, is the property of the School or its licensors and is protected by applicable intellectual property law. You may not reproduce, distribute, or create derivative works from this content without prior written permission, except for personal, non-commercial use.
9. Warranties and Disclaimers
This website and all content and services provided through it are furnished "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement, to the maximum extent permitted by law. The School does not warrant that the website will be uninterrupted, secure, or error-free.
10. Limitation of Liability
To the maximum extent permitted by law, the School, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of this website, including loss of use, data loss, emotional distress, or additional expenses. The School's total liability arising from your use of this website shall not exceed the amount you paid to the School through this website in the twelve months preceding the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless the School, its officers, directors, employees, agents, and affiliates from any claims, losses, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your misuse of the website, inaccurate information you provide, or any third-party claim related to your use of the website.
12. Force Majeure
The School shall not be liable for any delay or failure to perform due to events beyond its reasonable control, including acts of God, pandemics, weather events, utility or network outages, governmental actions, or cyber incidents.
13. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to conflict of law principles, and applicable federal law (including the E-SIGN Act, 15 U.S.C. § 7001 et seq., for electronic agreements). Any dispute arising from or related to these Terms or your use of this website shall be resolved exclusively through binding arbitration in Atlanta, Georgia, under the rules of the American Arbitration Association, unless prohibited by law. You waive any right to participate in class actions or representative proceedings. Judgment on the arbitration award may be entered in any court having jurisdiction. This provision is made pursuant to Georgia arbitration law (O.C.G.A. § 9-9-1 et seq.) and federal policy favoring arbitration.
14. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. To the extent any consumer protection rights under Georgia law (including the Fair Business Practices Act) or federal law cannot be waived, such rights are preserved notwithstanding any contrary language herein.
15. Amendments
The School reserves the right to modify these Terms at any time, with notice provided via the website or email. Continued use of the website after modifications constitutes acceptance.
16. Entire Agreement
These Terms, together with the Privacy Policy and, where applicable, the Enrollment Contract, constitute the entire agreement between you and the School regarding your use of this website and supersede all prior agreements or understandings on that subject. Electronic acceptance is binding under Georgia's Uniform Electronic Transactions Act (O.C.G.A. § 10-12-1 et seq.) and the federal E-SIGN Act.
17. Contact Information
For questions regarding these Terms, contact the School at 770-788-7100.
By using this website, submitting a form, making a payment, or making a donation, you acknowledge that you have read, understood, and agree to these Terms. These Terms are designed to comply with applicable Georgia and federal law while protecting the School's interests to the fullest extent permitted. Certain consumer rights may not be waivable under law, and nothing herein shall be construed to violate such protections. The School recommends consulting a qualified attorney for personalized legal advice.
